Charity law has "ossified" as charities are reluctant to challenge boundaries

Charity law has "ossified" according to the Charity Tribunal's first president Alison McKenna.
She believes this has happened because charities are reluctant to challenge the Charity Commission through the courts, the Law Gazette reports.
"Nobody is pushing the boundaries of case law," she told the publication.
The Charity Tribunal was set up under the Charities Act 2006 to hear appeals against decisions by the Charity Commission.
It also has powers to involve the Attorney General in point of law.
Ms McKenna hopes the body will speed up the evolution of charity law to keep pace with developments in the third sector.
Estimates of the tribunal's workload are carried, but it is funded on the expectation of 50 cases a year based on the workload of other tribunals under the Ministry of Justice.
The Charity Tribunal only has jurisdiction in respect of Charity Commission decisions made on or after March 18th 2008.
