Unfair trading regulations come into force
21 May 2008
New regulations affecting all UK businesses that trade with customers come into force next Monday, giving consumers protection from unfair trading.
The Consumer Protection from Unfair Trading Regulations will implement the Unfair Commercial Practices Directive (UCPD), banning 31 types of unfair commercial practices.
It will also establish a general principle against aggressive selling techniques and help to close loopholes that have been exploited by rogue traders.
The UCPD aims to ensure traders act fairly and honestly and simplify consumer protection.
Any business that doesn't comply will face possible prosecution.
Faking credentials, falsely claiming a product is available for a limited time only and running a closing down sale when the trader is not closing down could all result in two years imprisonment.
The regulations also make spam an offence in the UK.
