Adviser backs pre-nuptial agreements

An independent financial adviser has leant his backing to pre-nuptial agreements, saying they can make the divorce process "less stressful".
Equity Partners managing director Kevin Tooze also said the agreements could lessen the pain and reduce the cost of a separation.
In December 2007, the Crossley Vs Crossley divorce case involved Susan Crossley, who had signed a pre-nup before marrying Stuart Crossley.
However, during the proceedings she tried to claim the agreement was invalid because Mr Crossley had £60 million in accounts in Monaco and Andorra she was unaware of when signing the agreement.
She eventually abandoned her claim after a judge gave strong weight to the pre-nuptial agreement between them.
Mr Tooze said: "When things do go wrong you have already thought it through in the cold light of day not in the anger of divorce and it can make the whole splitting and designating of assets simpler and less stressful."
He added more couples were now considering pre-nuptials and said more people were ruing the lack of an agreement upon separating.
According to recent research by Scottish Widows, a million married people would sign a pre-nuptial if they could 'turn back the clock'.
