Government increases statutory legacy

The government has increased the level of the statutory legacy to provide greater benefits to married couples when one spouse dies without writing a will.

From February 1st next year, the new levels will increase from £125,000 and £200,000 to £250,000 and £450,000.

Commenting on the move, justice minister Bridget Prentice said it would provide "extra protection" for couples who have not made wills.

However, it also demonstrates the importance of making such arrangements by writing wills, Ms Prentice stated.

"Married couples and civil partners should not assume that when their spouse or civil partner dies, they will automatically be entitled to everything," she remarked

"It is up to individuals to make sure that their wishes are respected by making a will," she added.

Earlier this month, the minister urged people planning to move in with their partners to know their rights, as there is "no such thing as a common law marriage".

People without a financial stake in a property will have no entitlement to property if the relationship comes to an end, Ms Prentice warned.
