Law Society slams court fee rises that could put children at risk
06 June 2008
The Law Society has voiced "strong concerns" over rises in court fees in care proceedings.
It said setting fees on the basis of cost could leave vulnerable children at greater risk of harm, particularly in cases of neglect.
The Law Society said today it is "fundamentally opposed to the government's policy of full cost pricing to meet the costs of the civil and family courts, which provide a benefit for all society".
A statement read: "There is currently over recovery in relation to the civil courts, and this should be fed back into the system.
"There is also a strong case for public funding to support the work of the family courts in cases concerning the protection and welfare of children."
In February this year the Law Society and the NSPCC said the plans to increase court fees by more than 2,500 per cent could deny vulnerable children access to justice.
Government consultation Public Law Family Fees proposed an increase in fees in care proceedings from £150 to £4,000, which the groups said could deter local authorities from issuing care proceedings to save money.
Although £40 million would be set aside for the rise in court fees, the funding will not be ring-fenced.
The Law Society has said it will monitor and politically lobby on the issue.
