Elderly couples given the right to stay together in care homes

A change in the law will soon come into force to offer greater protection from degrading treatment for elderly residents living in private care homes.

Elderly couples that want to stay together in a private home will soon be able to challenge any decision to the contrary on grounds of the Human Rights Act.

Law lords recently ruled that the case of an 83-year-old woman suffering with Alzheimer's who was thrown out of a private care home was not covered by human rights legislation.

This was because only those people in public care homes are protected under the act.

Now an amendment to the health and social care bill has been put forward that extends protection to also cover the private sector.

Health minister Ivan Lewis told the Times that "everyone who has an elderly parent or grandparent will want to know we are doing everything to protect vulnerable older people from ill-treatment".
