Alan Yeomans v Varidoc Limited

B P Collins successfully acted for the Claimant (Alan Yeomans) in proceedings against the Defendant (Varidoc Limited) to recover a directors loan that was being unlawfully withheld by the Defendant. The full amount of the directors loan was recovered in the proceedings and the Defendant's Counterclaim struck out.

The Defendant was withholding the directors loan on the basis the Claimant refused to sign an extremely restrictive contract which would have prevented the Claimant from earning a living. The directors loan was repayable on reasonable demand and there were no further repayment conditions.

The Defendant brought a Counterclaim for £4,500 relating to computer software used by the Claimant for which the Defendant claimed ownership, however the Claimant had a licence over the software, and secondly, the Defendant counterclaimed an unliquidated sum whereby the Claimant had retained a computer programme which caused a delay to the performance of a contract between the Defendant and a third party, to which the Defendant claimed that the third party was threatening legal action. The Claimant had received written confirmation from the Managing Director of the third party informing the Claimant there was no intention to sue the Defendant.
