A director of a Hertfordshire firm has been banned from estate agency work by the Office of Fair Trading (OFT).
An independent adjudicator found that Daniel Zane had failed to comply with an obligation in the Estate Agents Act to provide written details of his fees and charges before an agreement was entered into with a purchaser.
It was also found that he failed to pass on offers promptly and in writing, misrepresented the status of a prospective purchaser and failed to provide his client with prompt written details of services provided.
Mr Zane also breached his duty to his client by seeking to obtain a 'secret commission' from a prospective purchaser without the informed consent of his client.
The Estate Agents Act applies to anyone engaged in estate agency work, which means introducing to someone else, a person who wants to buy, sell or lease land or property and/or being involved in negotiating the deal.
Some 10,000 estate agents are members of the National Association of Estate Agents, which was founded in 1962 to uphold good practice and high professional standards.
