Firm fined over health and safety failings

An engineering firm in Hampshire has been fined by the Health and Safety Executive (HSE) for breaking safety laws after a worker made a personal injury complaint.

The ruling related to a case involving an employee having used vibrating tools excessively while at work, causing him to sustain Hand Arm Vibration Syndrome.

Petersfield-based firm Tews Engineering Ltd was found guilty of breaching Section 2(1) of the Health and Safety at Work etc Act 1974 for having not protected the health of its employees.

It was also prosecuted for contravening Regulation 3(1) of the Management of Health and Safety at Work Regulations 1999 after it was found not to have carried out a suitable risk assessment.

The company received a fine of £10,500 for the two offences and was ordered to pay £10,500 in costs.

Ray Kelly, an inspector at the HSE, said: "Employers should take heed that when HSE finds evidence of flagrant breaches of health and safety law, particularly where there is a history of previous warnings and advice as was the case here, we will not hesitate to prosecute."

Last month, the HSE warned construction companies that maintaining equipment was essential after Apollo Cradles and Bradway Construction were both fined over an incident in which one man died and another three were injured while at work.
