Compulsory purchase compensation to rise

Homeowners whose properties are acquired by compulsory purchase orders will be entitled to higher levels of compensation later this year.

The Home Loss Payments (Prescribed Amounts) (England) Regulations 2008 come into force on September 1st 2008.

The law change will increase the amount of home loss payments payable in England under section 30 of the Land Compensation Act 1973.

Maximum payout limits will rise from £44,000 to £47,000 and the minimum amount will go from £4,400 to £4,700.

The regulation's explanatory note says: "These increases have been calculated by reference to the Department for Communities and Local Government's house price index, which varies in line with changes to house prices."

Only displacements happening after September 1st 2008 will be covered by the new amounts.

Compulsory purchase orders are used by local authorities throughout the UK to buy land which is not necessarily for sale where the purchase is needed to help deliver social and economic change.
