Scottish family loses IP case over narnia.mobi name
24 July 2008
A Scottish family has lost an intellectual property rights case over the narnia.mobi domain name after the World Intellectual Property Organisation (WIPO) said it should go to the CS Lewis Company.
Magazine the Lawyer reports Gillian Ferguson and Richard Saville-Smith have lost the right to keep the name they bought in 2006.
The couple had said the address was bought so their son, a fan of the books by author CS Lewis, could get emails at the address straight to his mobile phone.
Quoted by the Lawyer, the WIPO said it could not see any "plausible, good faith basis upon which the respondent could have concluded that he was free to appropriate the complainant's distinctive and widely-known Narnia mark for use as a personal email address."
Following the ruling, the family said the decision was a "scandalously one-sided appraisal of the evidence".
According to the publication, the Mr Saville-Smith has maintained the name has not brought the family any income.
Ownership of the name will now transfer to the CS Lewis Company following the WIPO decision.
